OmnikitThese Terms of Service (“Terms”) govern your use of Omnikit (the “App”), a Shopify application. By installing or using the App, you (“Merchant”) agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
1. The service
The App adds tools to your Shopify store, including wholesale pricing, wholesale registration, order limits, shipping protection, post-purchase upsells, back in stock alerts and product quizzes, and other features we may add or change over time. Shopify's platform, APIs, checkout and policies also apply to your store.
2. Eligibility and account
You must have authority to bind the Shopify store on which the App is installed. You are responsible for activity under your store's use of the App, and for complying with the laws that apply to what you sell and how, including consumer, pricing, marketing, privacy and tax rules.
3. Shipping protection
Shipping protection adds an optional fee that you set and keep. It is not insurance, and we are not a party to it: you decide how to handle claims for lost, stolen or damaged parcels, and you are responsible for describing the cover accurately to your customers.
4. Acceptable use
You agree not to:
- Use the App in violation of law, Shopify's Terms of Service or applicable App Store policies
- Attempt to probe, disrupt or circumvent security or rate limits
- Reverse engineer the App, except where the law does not allow this restriction
- Send emails through the App to people who did not ask for them, or misuse customer data
5. Billing
Paid plans, prices and free trials are shown in the App and billed through Shopify. Taxes may apply. Cancellation and refunds follow Shopify's billing rules and the terms shown when you subscribe, unless the law requires otherwise.
6. Your content and data
You keep the rights to your store data. You grant us a limited license to host, process and transmit data as needed to provide the App. We handle personal data as described in the Privacy Policy.
7. Intellectual property
The App, its branding and documentation are owned by us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the App for its intended purpose while it is installed.
8. Disclaimers
The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation; third-party systems, including Shopify and your theme, may affect how the App behaves.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, revenue or data, arising from use of the App. Our total liability for claims relating to the App is limited to the amount you paid us for the App in the twelve months before the event giving rise to liability (or, if none, fifty USD).
10. Termination
You may stop using the App by uninstalling it from Shopify. We may suspend or end access for breach, risk or discontinuation of the service where permitted. Provisions that by their nature should survive will survive.
11. Changes
We may change these Terms. We will update the date at the top of this page and, for material changes, give reasonable notice (for example in the App or by email). Using the App after the change takes effect means you accept it.
